Kenneth Roth´s August 4 opinion article is highly problematic, both for what it includes and what is absent ("Fog of War Is No Cover for Causing Civilian Deaths"). Roth´s questions are straw men (or women) that strip away the moral complexity and military reality facing Israel in this war...

After The New York Sun ran an editorial and two op-ed pieces taking Human Rights Watch to task for anti-Israel bias, the organization´s executive director, Kenneth Roth, has finally found it in himself to denounce Hezbollah for placing troops and weapons near Lebanese civilians...

"A War Crime at Qana?"

The Qana tragedy has intensified accusations that Israel's actions in Lebanon violate international law. Every death of an innocent person is extremely regrettable; but there is no evidence Israel has committed any war crimes...

Human Rights Watch has come out with a stinging attack on Israel for its actions in the conflict against Hezbollah, calling the tragedy in Qana a "war crime."
Since Human Rights Watch is not an organization that has ignored human rights issues in the Arab world — it has done studies on such issues as human rights violations in Egypt and suicide bombings — what the organization says is given much weight and credibility in certain circles...

As in most aspects of law, one should look for the rule of common sense, and in the overwhelming number of cases that will also be the legal solution. This is as true in international law as it is in internal legal systems. This yardstick also applies to the rules regarding the use of force and to the rules of armed conflict.
The present armed conflict between Israel and Hezbollah raises a number of international law issues...
